Protection starts with the right record

Intellectual-property questions differ according to the asset, ownership, registration position and conduct complained of. A brand dispute, a licensing disagreement and a copyright claim should not be approached as interchangeable problems.

Identify the asset

Keep registrations, applications, renewal details, brand-use records and the relevant creative or technical material together. Identify the owner and any licence, assignment or employment agreement affecting the rights.

Preserve the evidence

Keep dated examples of the disputed use, relevant webpages, packaging, correspondence and transaction records. Preserve the original files rather than relying only on edited screenshots.

Define the objective

Explain whether the immediate concern is protection, commercial use, a contested registration or disputed conduct. Advice on forum, urgency and relief depends on the actual record.

Brand misuse, a contested application or a licence dispute?

A trade-mark infringement claim, passing-off dispute, registry opposition and copyright complaint do not raise identical questions. Identify the right asserted, its owner, the disputed conduct and the immediate relief sought.

  • Keep application, registration, renewal, assignment and licence documents.
  • Preserve dated evidence of use, advertisements, packaging and relevant sales records.
  • Retain original files, source material and full web addresses for online use complained of.
  • Put any registry deadline, threatened launch, injunction or previous correspondence first.
