Understanding the documents and the stage of the dispute

Financing and debt matters can involve several agreements, securities, notices and connected proceedings. An initial review should distinguish the contractual position from the procedural stage and identify the immediate question requiring attention.

Material for review

Prepare the relevant facility and security documents, amendments, statements of account, demand notices, correspondence and orders already passed. Include a concise chronology and identify the parties, the amount in dispute and any approaching hearing or response date.

Scope and next steps

The proposed work is considered against the documents, the matter’s stage and the firm’s availability. Conflict checks and engagement terms are addressed before substantive work begins. Do not send confidential financial records through a general enquiry; an appropriate method for sharing documents should first be agreed.

Related resources

Official court, tribunal and regulatory resources provide access to relevant institutions. Legal Updates separates official-source notices from the reasoned analysis in Case Notes. These materials are general information, not advice on a particular debt or proceeding.

Money owed, a recovery notice or an insolvency proceeding?

I am trying to recover an unpaid amount

Identify who owes the money and why. Prepare the agreement, invoices, delivery or performance evidence, payment history and written acknowledgments. Separate the principal, claimed interest and disputed deductions. Explain earlier demands and any defence raised; an unpaid invoice alone does not establish every part of a claim.

I have received a demand or enforcement notice

Keep the complete notice, attachments and proof of receipt. Put the response date, proposed auction, possession step or hearing at the top of the chronology. Disclose any existing security, guarantee, settlement or order. Seek timely advice rather than assuming negotiations suspend the next step.

Which recovery route should be considered?

Ask counsel to explain the proposed forum, its requirements and alternatives against the actual documents. Contractual recovery, arbitration, secured enforcement and insolvency proceedings serve different purposes and should not be treated as interchangeable. Do not assume that the most forceful-sounding notice is the appropriate course.

What if I am a guarantor or there are connected proceedings?

Provide the guarantee and amendments, facility documents, notices and every relevant order. Identify proceedings involving the borrower, guarantors or security. Ask how the proposed step interacts with them; do not assume another party’s dispute or settlement resolves your position.

How can settlement be evaluated sensibly?

Explain what payment or performance is realistically possible and what is disputed. Ask for clear written terms addressing the amount, dates, conditions, security and treatment of existing proceedings. Understand the consequences of default and any release before agreeing. A settlement proposal is not the same as completed payment.

What should I know about cost and actual recovery?

Discuss the scope, professional fees, filing and other expenses, expected stages and how further work will be approved. Distinguish obtaining an order from enforcing it and receiving funds. No lawyer can assure recovery merely from the claimed amount, a filing or an order in principle.

Keep your financial information secure

For an initial enquiry, give a brief account, approximate disputed amount and urgent date. Do not send full bank statements, identity documents or confidential agreements through the general form. Never share passwords or one-time codes. Agree an appropriate document-sharing method with the office.

For NCLT matters, use the official Tribunal website for available case information and orders, and confirm the operative directions and next step with counsel.

General preparation guidance only. The applicable law, limitation, forum, security and procedural history require individual review. An enquiry does not confirm representation, extend a deadline or guarantee recovery.
